Trademark Assignment
Assignment or transmission of a trademark refers to the process by which the owner of a registered trademark/trademark whose registration is being sought, is passed from one party to another/ devolves upon the other party, as the case may be either completely with Goodwill or limited goods/ service without Goodwill. Assignment can be done by way of drafting Assignment Deed. Even an Unregistered Trademark can be assigned or transmitted with or without the goodwill of the business.

Registered Owner of trademarks can assign his trademarks to subsequent users

Any registered trademark can be assigned or transmitted with or without goodwill.
Registration of Assignment
Any person who becomes entitled by assignment or transmission to a registered trademark should apply for registration of the assignment/transmission, as the case may be, in the prescribed manner.
